Managing absenteeism in the workplace remains as challenging an issue as ever. HR professionals must take care to distinguish between culpable and non-culpable absences, which are sometimes intertwined. Human rights considerations must be taken into account at every step in connection with disabilities and family care.

In this presentation, we provide practical advice to employers and human resources personnel for managing disabilities in both unionized and non-unionized workplaces. We review the accommodation process, including the duty to enquire with respect to certain disabilities such as addiction. We also discuss appropriate methods for dealing with uncooperative employees and treating physicians, and vague or incomplete medical documentation.

We also take a closer look at common mental health issues (stress, depression, anxiety) and their impact on businesses, while discussing how employers can best manage absences and return to work processes, in light of existing case law from courts, human rights tribunals, and arbitrators.

Speaker bio(s)
Boris Subara

Boris Subara is a Partner at Fasken. He practices in all areas of labour and employment law and provides practical advice and representation to employers on a wide range of issues that arise during the course of the employment relationship. Among other things, Boris advises both provincially and federally regulated employers with respect to terminations, human rights issues, the management of absenteeism, administration of discipline, use of independent contractors, accommodation of workers, workplace investigations, and any employment issues arising in corporate transactions. In addition, Boris regularly drafts and reviews employment agreements, confidentiality, non-solicitation and non-competition agreements, workplace policies, programs, and other such documents. His practice also includes a strong focus on advocacy. He represents clients in a range of employment disputes, including employment and human rights litigation and labour arbitrations.
