This presentation will focus on best practices for attendance management in the workplace. Participants will learn practical approaches for managing employee attendance and the topics covered will include how to create an effective attendance support program and one which is supportive of staff well-being, which absences should and should not be included under the absence threshold, and when and how to obtain medical documentation. Finally, the program will review how an effective attendance support program can contribute towards an employer satisfying its duty to accommodate under the Code, and how and in what circumstances the employment relationship may be ended due to unsatisfactory attendance.

Gabrielle Lemoine

Gabrielle Lemoine is a labour and employment lawyer in Hicks Morley LLP’s Toronto office. She provides collaborative strategic advice and representation to employers and management in both the private and public sectors on a wide range of labour and employment issues. Gabrielle regularly advises on workplace accommodation, attendance management, employment standards, workplace drug and alcohol testing, wrongful dismissal, constructive dismissal and Charter issues. Gabrielle provides legal representation to clients in grievance arbitration and litigation. She regularly appears before labour arbitrators and has appeared before a variety of courts and administrative tribunals including the Ontario Labour Relations Board, the Ontario Divisional Court, the Federal Court, and the Federal Court of Appeal.
