This session provides HR professionals with essential insights into three critical areas of employment management: conducting legally sound workplace investigations, understanding and avoiding the repudiation of employment contracts, and staying current with the evolving Employment Standards Act. Participants will explore legal frameworks, practical strategies, and recent case law to better manage workplace risks and compliance. The session will examine where investigative shortfalls can lead to employer liability, how employers can inadvertently breach employment contracts, and what new obligations under the ESA mean for day-to-day HR practices.

Speaker bio(s)
Andrea Risk, Lawyer

Andrea is a partner in Cunningham Swan’s Labour & Employment Group. She graduated from Queen’s University in 1999 with numerous awards for outstanding achievement, including earning the highest standing in her graduating class. Prior to joining Cunningham Swan, she practised for several years with a major national law firm and gained significant trial experience. Andrea regularly assists employers by providing highly specialized and experienced assistance with legal aspects of all workplace issues. She has appeared before tribunals and all levels of court including the Supreme Court of Canada.


Kalen Ingram, Lawyer

Kalen is a partner with Cunningham Swan’s Labour and Employment group.  Kalen provides proactive and strategic advice to small and large employers in both the public and private sector on all matters relating to labour and employment law, and has represented her clients before the Human Rights Tribunal, the Workplace Safety and Insurance Board, the Ontario Labour Relations Board, the Ontario Court of Justice, and the Superior Court of Justice.


Tony Virgin

Tony is an Associate Lawyer with Cunningham Swan's Labour and Employment group. Tony assists employers from across Ontario with all matters relating to labour and employment law. He has appeared before the Human Rights Tribunal of Ontario and the Ontario Superior Court of Justice. He is a graduate of Dalhousie University and Queen's University. Outside of law, he enjoys spending time in the vibrant Kingston community, enjoying the charm of the local businesses downtown, and pursuing athletic challenge
