Some terminations of employment are more fraught than others, whether because of the personal circumstances of the employee, or the organization's exposure due to the employee's position on the org chart or their compensation level.

In this session, we will review the legal landscape and discuss practical strategies to identify and mitigate risk. 

LEARNING OBJECTIVES

  • Understand the risks of terminating employees on disability or statutory protected leaves and when it can be done, including how to balance medical information requests, employee communication and how to identify "frustration" of contract
  • How to manage high-level (C-suite) terminations, including assessing common contractual terms and governance considerations
  • Practical tips for carrying out high risk terminations to reduce risk

Speaker bio(s)
Jeremy Schwartz, Lawyer

Jeremy is a Partner at Stringer LLP, a leading management-side labour and employment law firm in Toronto. Jeremy routinely advises and represents employers in labour and employment, occupational health and safety, and human rights matters. He frequently writes and speaks on all manner of HR-law topics, including contract drafting, executive contracts and compensation, and related litigation. In addition to representing employers before arbitrators, the Ontario Labour Relations Board and Human Rights Tribunal of Ontario, Jeremy has represented employers at all levels of Ontario's courts, as well as before the Supreme Court of Canada. Jeremy enjoys sharing his love of skiing and swimming with his daughters, he is a determined but terrible golfer, and he is always looking to take on projects around the house – to justify buying new tools.
