PD Day: Legal Update

Morning: Human Resources Policies and Employment Agreements: The "Musts", "Should's" and "Could's" - Liam Ledgerwood

Employers are required to have an ever-increasing amount of workplace policies. It is hard to keep up. At the same time, legal and recruitment pressures are pushing employers to think beyond the bare minimum by developing customized agreements and HR policies to suit their specific needs.

In this session, we will start at the foundations - what HR policies are employers required to have, and what must they say? We will then consider the bigger picture by discussing the HR policies and contractual terms that employers should consider using not only to protect the organization from employment liability, but also to reduce workplace friction, and attract (and keep) top talent.

Learning Objectives:

  • Identify mandatory HR policies and their required content
  • Identify optional HR policies and their suggested content
  • Review best practices with respect to employment agreements, included key terms

Afternoon: Terminating Employment Relationships: What You Need To Know - Zaheer Lakhani

Although employers have the right to end the relationship with an employee, this right comes with legal obligations and corresponding pitfalls. In fact, if the termination is not done properly and lawfully, the damages that can result can be substantial. This session will offer guidance on an employer’s legal obligations with respect to terminations, how to structure a termination package and offer guidance on how to arrive at a negotiated outcome as opposed to spending legal fees in litigation.

Learning Objectives:

  • the meaning of “for cause” vs “without cause” terminations
  • how to recognize high risk terminations
  • the potential cost of dismissing a long service employee
  • practical tips for ending employment relationships
  • complying with legislative requirements, the Employment Standards Act, the Ontario Human Rights Code and the Occupational Health and Safety Act

Liam Ledgerwood

Liam J. Ledgerwood is an associate with our labour and employment group and provides a wide range of practical and creative solutions for employers. In this role, Liam provides both effective advocacy before courts and administrative tribunals and pragmatic day-to-day advice to employers. Prior to joining the labour and employment group, Liam received his Juris Doctor from Western University's Faculty of Law and articled with Siskinds.


Zaheer Lakhani, Lawyer

Zaheer Lakhani is a partner at the boutique law firm Lakhani Campea LLP, which specializes in employment law, workplace investigations and litigation services. Called to the Bar in 1998, Zaheer advises and represents various sized employers as well as individuals  in a variety of areas such as human rights, including disability and accommodation; wrongful dismissal claims; employment standards compliance and litigation, and general strategic HR advice.

Zaheer is frequently sought out to provide third party investigation services for various employers including municipal clients, school boards, and Canadian Universities. In the spring of 2020, his investigation involving the conduct of an elected school board trustee was referenced in various news media including the Ottawa Citizen, CBC, Toronto Star and the Globe and Mail.

Zaheer has also appeared as a guest on CBC Radio and Radio Canada to discuss discrimination and toxic workplaces and he was quoted by the Canadian Safety Reporter in an article related to workplace harassment. Zaheer has delivered presentations on a variety of topics on behalf of various chapters of the Human Resource Professional’s Association (HRPA), the HRPA’s annual conference, as well as the Ontario Municipal Human Resources Association (OMHRA) Spring and Fall Conference. Most recently, he delivered a presentation discussing the Impact of Racial Bias and Racism in the Workplace.
