Hena Singh and Alex Van Kralingen are lawyers who are experienced with all facets of workplace investigations.  Both Hena and Alex will provide perspective and best practices regarding how to organize and document workplace investigations in order to ensure their quality, fairness, impartiality, compliance with the relevant statutory and common law, and to ensure they can be easily relied upon for future proceedings. Alex and Hena will also discuss common pitfalls in the conduct of workplace investigations that can be avoided.

Specific areas of discussion will include:

  1. The benefit of third-party investigations vs. ‘in-house’ investigations;
  2. How to organize and approach investigations, including:
  • Mandate letters
  • Sequencing of Interviews
  • Rights of parties in the process
  • The role of lawyers and union representatives in the interviews
  • Conducting re-Interviews, where required

       3. Ethical considerations in the investigation process;

       4. The content requirements for the investigation report;

      5. Questions surrounding privilege and confidentiality;

  • Who is your investigator, and do they have the background to attract privilege;
  • Fact-Finding vs. Questions of Law and the impact on privilege; and
  • How disclosure of the report can lose any privilege that may be associated with it; and

     6. Reporting Requirements to Complainants and Respondents

Hena Singh

After gaining years of experience at both a national Bay Street law firm and a boutique employment law firm, Hena Singh started her own employment law and workplace investigation practice with the goal of providing her clients with practical and tailored solutions to employment and human rights issues. Hena is recognized by her clients and colleagues as effective in her use of Alternative Dispute Resolution (ADR) methods and negotiation skills to explore options, which often negate the necessity or reduce the risk of litigation. These methods can provide options which achieve the best possible outcome for all parties, while avoiding the acrimony associated with litigation. However, Hena also recognizes that certain circumstances and cases are better resolved through litigation. Hena is recognized for understanding and applying legal nuances critical to ensuring that the various angles of a particular issue are considered. With experience in both ADR and litigation, Hena has the skills necessary to advise on each process and assess the most effective, efficient and cost-sensitive approach for her clients.


Alex Van Kralingen

After practising at two large Bay Street firms, and later at a leading litigation boutique in Toronto, Alex started his own firm in 2012, and most recently has become a founding partner of Van Kralingen & Keenberg LLP. Alex maintains a diverse practice in both commercial/civil litigation and employment law. In his commercial and civil litigation practice, Alex frequently represents companies and individuals in actions alleging misrepresentation, fraud, defamation and other economic torts, mortgage enforcement, as well as pursuing and defending actions relating to shareholder rights, including oppression remedy cases. Alex also has significant experience with professional liability actions, particularly as against lawyers. Further, Alex has successfully brought and defended injunctions against competing businesses, including Anton Piller orders. Alex has successfully represented foreign clients in Letters Rogatory applications and other Ontario-based litigation. He has also represented individuals in applications pursuant to the Civil Remedies Act, achieving significant recoveries from assets seized by the government.
