Hena Singh and Alex Van Kralingen are lawyers who are experienced with all facets of workplace investigations. Both Hena and Alex will provide perspective and best practices regarding how to organize and document workplace investigations in order to ensure their quality, fairness, impartiality, compliance with the relevant statutory and common law, and to ensure they can be easily relied upon for future proceedings. Alex and Hena will also discuss common pitfalls in the conduct of workplace investigations that can be avoided.
Specific areas of discussion will include:
- The benefit of third-party investigations vs. ‘in-house’ investigations;
- How to organize and approach investigations, including:
- Mandate letters
- Sequencing of Interviews
- Rights of parties in the process
- The role of lawyers and union representatives in the interviews
- Conducting re-Interviews, where required
3. Ethical considerations in the investigation process;
4. The content requirements for the investigation report;
5. Questions surrounding privilege and confidentiality;
- Who is your investigator, and do they have the background to attract privilege;
- Fact-Finding vs. Questions of Law and the impact on privilege; and
- How disclosure of the report can lose any privilege that may be associated with it; and
6. Reporting Requirements to Complainants and Respondents
