This presentation will focus on two important aspects of the employment relationship, constructive dismissals and an employer's duty to accommodate. Part 1: In today's dynamic workplace, understanding constructive dismissal is essential for effective management. We will explore what constitutes constructive dismissal under Ontario employment law, providing insights into the nuances of these claims with real-world examples of changes that could trigger them. Part 2: We will delve into a discussion on an employer's duty to accommodate. Attendees will learn about their obligations to support employees facing personal challenges, the legal consequences of failing to properly accommodate, and how to handle situations where employees may be reluctant to return to work. Both parts will include interactive Q&A segments, allowing attendees to test their new knowledge against real cases decided by Ontario courts.

LEARNING OBJECTIVES

  • Understand what constitutes constructive dismissal.
  • Learn strategies to prevent constructive dismissal claims by employees.
  • Learn about an employer's duty to accommodate employees who are away from work or can only perform partial duties.
