The pending legalization of recreational marijuana has made the topic of fitness for duty more important than ever for HR professionals; this program will cover the state of the law regarding medical marijuana, human rights, and health and safety in the workplace.

In this session, participants will hear a review of the current state of the law with respect to cannabis, medical marijuana, and the legalization proposed for July 1, 2018; fitness for duty and prohibiting alcohol and drugs from the workplace; human rights challenges dealing with A&D dependency and addiction by workers; A&D testing law in Canada; and developing an effective A&D fitness for duty police.

Norm Keith

Norm Keith is a senior partner practicing in the areas of regulatory, employment and white collar defence and investigations across Canada and internationally.

Mr. Keith is the leading occupational health and safety (OHS) lawyer in Canada. He advises and represents employers, officers and directors, and managers regarding OHS/WSIB compliance, accident investigations, and litigation across Canada. He has successfully defended hundreds of OHS prosecutions at trials and appeals.

Mr. Keith has written many of the leading texts in the OHS field, including Canadian Health and Safety Law, Canadian Emergency Management and Response Manual, and Workplace Health and Safety Crimes (3rd Edition), dealing with the Bill C-45 amendments to the Criminal Code. Mr. Keith was the first practising lawyer in Canada to earn the Canadian Registered Safety Professional (CRSP) designation. He is a highly sought after speaker by employers, business associations, bar associations, universities, and risk management conferences. He has been a course developer and an instructor in the ASSE Global Safety Risk Management certificate course since 2013. He has been a judge for the prestigious Thomson Reuters Canada's Safest Employer Awards since 2014.

Mr. Keith has an active Human Resources practice. He advises on employment contracts, HR policies, hiring, discipline, workplace fraud, and dismissal of executives, managers and unionized workers. He defends employers in wrongful dismissal, human rights, union grievances, and fiduciary duty civil litigation. He represents employers in fraud, conversion and recovery civil actions. He conducts workplace investigations for employers, boards of directors and special board committees in whistle-blower and related complaints. Mr. Keith also has considerable expertise in dealing with alcohol and drugs issues in the workplace; he has written Alcohol & Drugs in the Canadian Workplace (2nd edition); and in dealing with harassment and violence issues in the workplace and has written the Human Resources Guide to Preventing Workplace Violence (2nd Edition).
